La reforma, publicada en mayo de 2023, establece el proceso de ratificaci\u00f3n del titular de la Fiscal\u00eda General de Justicia de la Ciudad de M\u00e9xico por un periodo similar al de<\/strong> su nombramiento.<\/p>\n\n\n\n

CIUDAD DE M\u00c9XICO .- El Pleno de la Suprema Corte de Justicia de la Naci\u00f3n (SCJN) aval\u00f3 la llamada \u201cLey Godoy\u201d, con la que se estableci\u00f3 el proceso de ratificaci\u00f3n del titular de la Fiscal\u00eda General de Justicia de la Ciudad de M\u00e9xico (FGJCDMX) por un periodo similar al de su nombramiento.<\/p>\n\n\n\n

Dicha reforma fue publicada en mayo de 2023 por el Congreso de la capital y deriv\u00f3 de una iniciativa presentada por la entonces fiscal, Ernestina Godoy quien buscaba permanecer en el cargo durante cuatro a\u00f1os m\u00e1s bajo el argumento de que realizar\u00eda una reestructuraci\u00f3n administrativa al interior de la FGJCDMX.<\/p>\n\n\n\n

La reforma fue conocida como \u201cLey Godoy\u201d no s\u00f3lo porque fue la fiscal quien la present\u00f3 sino que lo hizo a unos meses de concluir su cargo como titular de la instituci\u00f3n.<\/p>\n\n\n\n

Al analizar la acci\u00f3n de inconstitucionalidad presentada por los diputados locales de la oposici\u00f3n, la SCJN se\u00f1al\u00f3 que no hubo violaciones al procedimiento legislativo por el que se aprob\u00f3 la reforma.<\/p>\n\n\n\n

\u201cLa propuesta que someto a su consideraci\u00f3n propone declarar infundado el argumento relativo a que durante el procedimiento legislativo que dio origen al decreto impugnado se cometieron vicios con potencial invalidante la propuesta considera que se siguieron tanto, las reglas de votaci\u00f3n, como la debida publicidad, asimismo se respet\u00f3 el derecho de participaci\u00f3n de las diversas fuerzas pol\u00edticas a lo largo de todo el tr\u00e1mite legislativo\u201d, expuso el ministro ponente, Juan Luis Gonz\u00e1lez Alc\u00e1ntara Carranc\u00e1.<\/p>\n<\/blockquote>\n\n\n\n

El proyecto fue avalado por mayor\u00eda de 10 votos pues el ministro Luis Mar\u00eda Aguilar Morales vot\u00f3 en contra.<\/p>\n\n\n\n

\u201cYo considero que s\u00ed se viol\u00f3 el procedimiento de aprobaci\u00f3n, precisamente como lo alegan los demandantes, en la cuesti\u00f3n del acceso, de la posibilidad de que todos los diputados pudieran acceder\u201d, indic\u00f3.<\/p>\n<\/blockquote>\n\n\n\n

Por unanimidad el Pleno aval\u00f3 tambi\u00e9n las reglas de conformaci\u00f3n del Consejo Ciudadano que ser\u00e1 quien analice la ratificaci\u00f3n del fiscal capitalino.<\/p>\n\n\n\n

Aunque esta reforma fue utilizada para realizar el proceso de ratificaci\u00f3n de Godoy, la funcionaria no obtuvo la mayor\u00eda calificada de votos requerida en el Congreso de la Ciudad de M\u00e9xico por lo que su intenci\u00f3n fue rechazada.<\/p>\n\n\n\n

Desde enero pasado, Godoy fue sustituida de manera provisional por Ulises Lara hasta que el Congreso capitalino designe a un nuevo titular, proceso que, aunque inici\u00f3 en febrero pasado, ante la renovaci\u00f3n del Legislativo local en junio pr\u00f3ximo, es posible que culmine hasta el \u00faltimo trimestre de 2024.<\/p>\n\n\n\n
