{"id":99810,"date":"2026-10-01T12:59:38","date_gmt":"2026-10-01T18:59:38","guid":{"rendered":"https:\/\/informacionatiempo.com\/?p=99810"},"modified":"2026-10-01T12:59:39","modified_gmt":"2026-10-01T18:59:39","slug":"articulo-19-rechaza-aprobacion-de-ley-antimemes","status":"publish","type":"post","link":"https:\/\/informacionatiempo.com\/index.php\/2026\/10\/01\/articulo-19-rechaza-aprobacion-de-ley-antimemes\/","title":{"rendered":"Art\u00edculo 19 rechaza aprobaci\u00f3n de \u201cLey Antimemes\u201d"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Art\u00edculo 19 rechaz\u00f3 la reforma aprobada por el Senado al C\u00f3digo Penal Federal y a la Ley Federal de Protecci\u00f3n a la Propiedad Industrial,<\/strong>&nbsp;al advertir que la creaci\u00f3n de delitos relacionados con el uso o imitaci\u00f3n de la identidad gr\u00e1fica gubernamental podr\u00eda utilizarse contra periodistas, activistas y ciudadanos que recurran a esos elementos en contenidos informativos, cr\u00edticos o sat\u00edricos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Se\u00f1al\u00f3 en un comunicado que las disposiciones contemplan penas de prisi\u00f3n cuando el uso de la identidad gr\u00e1fica institucional concurra con elementos como la escala comercial, el enga\u00f1o y la intenci\u00f3n de cometer un il\u00edcito, pero consider\u00f3 que la redacci\u00f3n carece de la claridad y precisi\u00f3n necesarias para delimitar las conductas que ser\u00edan sancionadas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sostuvo que la falta de salvaguardas expl\u00edcitas podr\u00eda generar un efecto inhibidor sobre expresiones protegidas constitucionalmente, debido al riesgo de que periodistas, activistas o ciudadanos eviten determinados contenidos ante la posibilidad de enfrentar procedimientos penales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>\u201cEstas disposiciones podr\u00edan utilizarse para hostigar a periodistas, activistas y otras personas que emplean la identidad gr\u00e1fica gubernamental en contenidos sat\u00edricos, cr\u00edticos e informativos\u201d,&nbsp;<\/em><\/strong>advirti\u00f3.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reconoci\u00f3 que la reforma puede perseguir una finalidad leg\u00edtima, como prevenir fraudes, pero se\u00f1al\u00f3 que el Estado debe justificar por qu\u00e9 resulta necesario recurrir a penas privativas de libertad y por qu\u00e9 otros mecanismos no penales ser\u00edan insuficientes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tambi\u00e9n sostuvo que el uso del derecho penal en asuntos relacionados con la libertad de expresi\u00f3n genera un efecto \u201cdisuasivo, atemorizador e inhibidor\u201d que puede trascender a la persona directamente sancionada y desalentar la participaci\u00f3n de otras personas en el debate p\u00fablico.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art\u00edculo 19 pidi\u00f3 a la C\u00e1mara de Diputados atender las cr\u00edticas sobre los riesgos de la reforma y rechazar la propuesta en su totalidad, al considerar que la legislaci\u00f3n penal debe establecer con claridad y precisi\u00f3n las conductas prohibidas para garantizar la seguridad jur\u00eddica y el respeto a los derechos humanos.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Art\u00edculo 19 rechaz\u00f3 la reforma aprobada por el Senado al C\u00f3digo Penal Federal y a la Ley Federal de Protecci\u00f3n a la Propiedad Industrial,&nbsp;al advertir que la creaci\u00f3n de delitos relacionados con el uso o imitaci\u00f3n de la identidad gr\u00e1fica gubernamental podr\u00eda utilizarse contra periodistas, activistas y ciudadanos que recurran a esos elementos en contenidos [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":99811,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"inline_featured_image":false,"footnotes":""},"categories":[103],"tags":[],"class_list":["post-99810","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-nacional"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.6 -
